A U.S. federal judge has ordered President Donald Trump to testify under oath by December 11, in a defamation lawsuit he filed against the British Broadcasting Corporation (BBC), seeking $10 billion in damages, following a documentary that accuses the organization of misleading the public regarding his statements before the Capitol riot in 2021.
Judge Angeli L. Tait issued an order (on Thursday) setting the deadline for Trump to appear in court, after BBC lawyers accused the U.S. president of delaying his testimony, despite a previous date set for October 16.
In a memorandum submitted to the court (on Wednesday) by Trump’s defense team, his lawyers requested to postpone his testimony to the period between January 11 and 22, 2027, citing his presidential commitments and issues they claimed have significantly impacted U.S. national security and the economy.
The justifications provided by the defense included developments related to the wars in Ukraine, along with what they described as the “White House agreement on superintelligence.” The lawyers denied that Trump was intentionally avoiding giving his testimony, considering the accusations from the British organization in this regard to be incorrect.
However, BBC lawyers presented a different narrative, pointing out that Trump participated in a campaign event in Georgia on October 16, which they based on a report from the White House press team that included details of his movements that day.
The British organization believes that Trump’s participation in a political activity, instead of adhering to his testimony date, undermines the justifications for the postponement provided by his legal team.
The lawsuit puts Trump in a legal test in a case he initiated himself, as he may be compelled to answer questions from the organization’s lawyers under oath regarding the damages he claims to have suffered as a result of the documentary, and the facts he relies on in accusing the BBC of defamation.
The case dates back to a documentary titled “Trump: A Second Chance,” aired by the British organization, which included clips from a speech Trump delivered on January 6, 2021, the day his supporters stormed the U.S. Capitol in an attempt to disrupt the certification of Joe Biden’s victory in the 2020 presidential election.
Trump accuses the organization of editing parts of his speech in a misleading way, suggesting that he urged his supporters to use violence, by combining segments of his statements in a manner that altered the public impression of their content and context.
The incident sparked a crisis within the BBC, after the organization acknowledged a problem with the way the clips were edited and issued an apology, while several senior officials resigned in the wake of the case’s repercussions. However, the organization denied that the film caused Trump any harm that justifies the compensation he is seeking, and requested the court to dismiss the lawsuit.
